The majority of employment relationships in California are “at-will.” This means that you can leave your job at any given time for no reason, and your employer can terminate you under the same circumstances. Harassment & Discrimination

If you feel that you have been fired because of your race, disability, pregnancy, religion, sex, or nationality, that is called discrimination, and it is against the law. In the same vein, if you are not fired but treated differently at work or harassed at work for these reasons, you are also protected by federal law in these circumstances.

Hostile Work Environment

You may have a case for hostile work environment if the atmosphere of your work prohibits you from performing or makes you feel scared or uncomfortable to be there.

Unpaid Wages

You can file an unpaid wages claim if YOU ARE not paid promptly. In the state of California, you are entitled to be paid by the 26th of the month for wages earned between the 1st and the 15th, and by the 10th of the month for wages earned between the 16th and the end of the previous month. You are also ENTITLED to be paid your final paycheck promptly after you quit or are fired.

Unpaid Overtime

Generally, people work overtime based on the expectation that they will be paid extra for working more hours. If your employer has failed to follow through, you may be able to file an unpaid overtime claim.

Meal & Rest Break Violations

In California, if you are a non-exempt worker, you can receive a 30-minute meal break for a 5-hour workday and 10-minute breaks for every 4 hours you work. If your employer is not letting you practice your rest time, they may be violating the California law.

Minimum Wage Violations

If you are not being paid minimum wage, you are being cheated by your law-breaking employer. Don’t settle for less than you deserve; file a minimum wage violation claim to get the wages you rightfully earned.
